A division bench of the Gujarat High Court (HC) Tuesday restricted Gujarat University (GU) from giving gold medal in the subject of Drafting of LL.B for the year 2012 till March 13. The bench comprising of Justices V M Sahai and S G Shah passed an order in this regard while acting on a students petition in which she claimed the medal. The court directed the Registrar General of the HC to send the order to the GU authorities by a fax as the award ceremony was scheduled Tuesday evening.
The petitioner student has been identified as Shital Pandya,a third year law student of D T Law College in Ahmedabad.
According to Pandyas lawyer Hitesh N Dave,she cleared the LLB examination taken in April 2012. In the Drafting subject,she scored 97 out of total 100 marks which was highest. She had claimed a gold medal for the subject which is being given by a donor. However,the GU authorities refused to give her the medal as in another subject,Legal Language,she was given grace marks and she had applied for reassessment. And after reassessment,she passed the paper without grace marks.
Dave said the GU authorities were denying Pandya the gold medal on the basis of a rule of the university under which a student was not entitled for the gold medal in case she had applied for reassessment.
Dave said they have based the petition on the ground that Pandya had not applied for reassessment of Drafting paper; also,after the reassessment of Legal Language paper,she had cleared the paper and got rid of grace marks.
The court has stayed award ceremony for the paper of Drafting till March 13 when the matter is posted for further hearing. Since the award ceremony was scheduled today evening,the court directed the Registrar General to intimate the GU authorities about the order immediately by fax, Dave said.
