Lawyer appeals judge to withdraw from blasts case on moral grounds

One of the defence advocates in the July 26 Ahmedabad serial blasts cases,I M Munshi,in an application moved before the court of Ahmedabad City Sessions Judge,Bela Trivedi,has asked her to withdraw from the trial of the serial blasts cases on moral grounds.

One of the defence advocates in the July 26 Ahmedabad serial blasts cases,I M Munshi,in an application moved before the court of Ahmedabad City Sessions Judge,Bela Trivedi,has asked her to withdraw from the trial of the serial blasts cases on moral grounds.

The state government has appointed Bela Trivedi as the designated sessions judge to hold the trial of the blast cases.

According to the details of the matter,Munshi recently happened to see one of the investigating officers of the July 26 serial blasts case coming out of the chamber of the judge. Following this,and fearing the trial in the court of the judge to be partial,Munshi has filed the application.

Talking to Newsline,Munshi said,”On February 9,I was sitting in the courtroom waiting for the judge to come out of her chamber for court proceedings. As the door of the judge’s chamber opened,V R Toliya,one of the investigating officers of the blast cases,came out of the chamber.”

He said,”As soon as Toliya saw me,he hastily left the courtroom.”

Munshi was present in the courtroom for the hearing of a revision application of Faqir Mohammed Mansuri,the father-in-law of Sajid Mansuri,one of the accused in the blasts case.

Faqir has been demanding to get back his motorbike which was seized by the Ahmedabad City Detection of Crime Branch (DCB) from Sajid following his arrest in August last year.

On Wednesday,the hearing on the matter was scheduled but it ha now been adjourned to March 9.

Toliya is investigating the case related to the blasts which occurred in Ahmedabad Civil Hospital premises killing more than 35 persons.

Munshi said,”I do not think that we’ll get justice from the court of the judge after the manner in which I saw Toliya coming out of her chamber and hurriedly left the courtroom after seeing me.”

“And so,she should withdraw herself from conducting court proceedings in all the blast related matters,”

he said.
