Ishrat encounter: Another cop moves court for bail

Another accused policeman arrested in the 2004 Ishrat Jahan and other encounter cases moved a default bail application before the special CBI court Tuesday.

Another accused policeman arrested in the 2004 Ishrat Jahan and other encounter cases moved a default bail application before the special CBI court Tuesday. The court has scheduled the matter for hearing on Wednesday.

CBI had arrested Anaju Chaudhary,an SRP commando,on February 27. He has sought bail on the ground that the probe agency failed to file chargesheet after completion of 90 days since his arrest under the provisions of section 167(2) of the CrPC that entitles an accused to get default bail in such circumstances.

By February,CBI had arrested five policemen,out of them four were granted bail on Monday on similar ground including suspended IPS officer G L Singhal,DSP Tarun Barot,DSP (retired) JG Parmar and police inspector Bharat Patel.

At the time of encounter,Chaudhary was an SRP commando working under Barot. It was Chaudhary’s gun,which is said to have been used in the execution of encounters of Isharat Jahan,Javed Shaikh alias Pranesh Pillai,Amjadali Rana and Zeeshan Johar on June 15,2004.

This encounter is the first case out of a total of four encounter cases being probed by the CBI in which accused policemen were granted bail due to the probing agency failing to file chargesheet within 90 days of arrests.
