The city Detection of Crime Branch (DCB) Wednesday obtained custody of five of the 2008 Ahmedabad Serial Blasts case accused from a special court after the state government lifted section 268 of Criminal Procedure Code from them that restricted their mobility from the jail.
The five have been taken into custody in connection with an FIR lodged in the failed attempt to escape from the Sabarmati Central Jail through a clandestine tunnel earlier this month.
According to Sudhir Brahmbhatt,special public prosecutor in the case,the five have been identified as Saduli Abdul Karim,Sibli Pidical,Hafeez Hussain Tajuddin Mulla,Naseer Ahmed Liyakatali Patel and Zahid alias Javed Shaikh.
The jailbreak plan was unearthed on February 10 when authorities found a six-foot deep and 26-foot long tunnel in the jail. An FIR was lodged in the case and 14 accused in the 2008 Ahmedabad serial blasts case were named accused in the case. The case has been transferred to DCB.
On Tuesday,DCB had procured transfer warrant for the 14 from a Metropolitan Court while informing it that the Section 268 of CrPC imposed on the serial blasts accused has been lifted for their custodial interrogation in the case by the state government.
Subsequently,Brahmbhatt said,DCB moved an application to get the custody of the five from the special trial court for the serial blasts case Wednesday. The court allowed the application following which the five have been taken into custody.
They are likely to be produced before the Metropolitan Court on Thursday,when DCB is likely to seek their remand.
