‘Custodial death’: High Court junks Bhatt’s petition

The Gujarat High Court on Friday dismissed the petition of suspended IPS officer Sanjiv Bhatt that had challenged a Jamnagar Sessions Court’s order to dismiss his revision plea against a magisterial court’s order to initiate criminal proceedings against him and others for murder and allied charges.

The Gujarat High Court on Friday dismissed the petition of suspended IPS officer Sanjiv Bhatt that had challenged a Jamnagar Sessions Court’s order to dismiss his revision plea against a magisterial court’s order to initiate criminal proceedings against him and others for murder and allied charges.

A single-judge bench of Justice R H Shukla passed the order.

According to government pleader Prakash Jani,who represented the government,the case relates to 1990 when Bhatt was posted as an ASP.

One Prabhudas Vaishnani was arrested in a rioting case along with many others. And after being released from the jail in the case,he died of renal failure. Following this,his brother lodged a complaint against Bhatt and six other police officials holding them responsible for custodial torture and murder of his brother.

According to the complaint,Bhatt and other policemen had subjected Vaishnani to custodial torture that seriously damaged his kidneys. A concerned magisterial court had ordered to initiate criminal proceedings against him on the basis of the complaint.

The state government had challenged the order of the magisterial court by filing a revision application before the sessions court. However,the state government had withdrawn the revision application last year. Following that,Bhatt and other policemen moved a revision petition against the magisterial court’s order.

The concerned sessions court of Jamnagar district had rejected his revision application following which he had approached the HC.
