Ban on diesel cars is corporate death penalty: Toyota tells NGT

Leading car manufacturer Toyota has moved the National Green Tribunal arguing that the idea to ban diesel vehicles across the country was like a “corporate death penalty” as it impacts the existence of the company.

In its plea, the automobile company said ban on the registration of diesel vehicles manufactured by the applicant company is “unfair and unjust” as it was complying with all the laws and any restriction would severely impact its sales and the livelihood of thousands of people engaged in the automobile sector.

“The applicant company is being penalised for no fault or violation on its part thereby making the order banning registration of diesel cars as unjust and unfair on the company.

“The imposition of ban on registration of diesel vehicles is in the nature of a corporate death penalty as it impacts the very existence of the company. A ban order is an extremely harsh/excessive punishment and ought to be imposed in circumstances where a party commits a serious violation and not when there is no violation,” Toyota said.

The petition, which is likely to come up for hearing before a bench headed by NGT Chairperson Justice Swatanter Kumar on August 2, has sought impleadment in a case filed by lawyer Vardhaman Kaushik on air pollution in Delhi.

The plea, filed through advocates Vijay Sondhi and Cauveri Birbal, said there is no link between engine capacity and emission levels and as per Motor Vehicles Act “the engine capacity of a motor vehicle is not even a factor that is taken into consideration by the government for prescribing the applicable mass emission standards”.

Later, the Supreme Court ordered that the diesel-run SUVs and cars having engine capacity beyond 2000 cc would not be registered in Delhi and National Capital Region.

Subsequently, the tribunal, which was restrained by the apex court from dealing with matters on air pollution in Delhi, expanded the ambit of hearing by seeking responses on worsening air quality in metropolises like Mumbai, Kolkata and Chennai.

Referring to a report from IIT Kanpur, the company said that out of various sources of pollution, the contribution of vehicular pollution is 20 per cent which comes from all types of vehicles including two-wheelers, three-wheelers, passenger cars, light commercial vehicles and heavy commercial vehicles.

“It is also to be noted that these vehicles do not use only diesel as a fuel but also use other types of fuels like Petrol, CNG and LPG…Thus the contribution of 4 wheeler vehicles being only 10 per cent out of the 20 per cent overall load of all types of vehicles would mean that such four wheeler vehicles contribute only 2 per cent of total PM 2.5 emission loads in Delhi,” it said.

Toyota said that the impression that diesel adversely affects the environment and is largely responsible for air pollution while emissions from petrol and CNG does not adversely affect the environment is completely “misconceived and misplaced”.

With regard to its Innova model, the company has said that it is a public carrier vehicle which can accommodate more number of passengers and is therefore a more environment friendly car.

“Toyota Innova which is a six-seater vehicle is not used by the financially affluent sections but by common masses, and is known as a peoples carrier vehicle…

“A car like Toyota Innova which is not only used by the masses but also reduces pollution by reducing the need for an additional vehicle, ought to be kept out of the restriction imposed on registration of diesel vehicles of 2000 cc and above,” the plea said.

Toyota further said it has invested approximately Rs 1200 crores in a high performance, high technology diesel engine project in Karnataka which will also generate employment to over 500 people.

    So be it let the corporate die instead of planet earth. Why does Innova need a 2.5L diesel engine???? When similar capacity vehicles can be hauled using more frugal 1.5L engines. lt;br/gt;How many Diesel units does Toyota sell in US?

      Who are these s that call themselves the National Green Tribunal. They sound like a bunch of s from an asylum. The West has far more intelligent people than these minions of the NGT, and diesel vehicles here run under a very strict 'Fitness Certificate' called MOT which is carried out every year. On an average it costs people around Rs 30,000 in �s to get this certificate.

        What is the equation between death due to diesel exhaust and corporate death at 4 km per hour wasting 90% of diesel? India should give living energy full opportunity. Take to normal civilization which protects and enriches life than death dealing forever crawling cars on Indian roads. How many lives per liter?
